Can Someone Own the Name Graphic Design Forum?

Jupiter Media claims to own the words Graphic Design Forum and they say they have trademarked this common and generic phrase. Basically the many graphic designers who use this term online are causing confusion in their market place.
Should this be legal? Next thing you know we won't be able to say we do graphics because they own Graphics.com too.
Any comments from others out there?
